Filing for Custody in Lorain County

Lorain County, Ohio · Elyria

In Ohio, 'custody' means the allocation of parental rights and responsibilities. Lorain County runs a combined Domestic Relations & Juvenile Division at 225 Court Street, but where custody is decided depends on whether the parents were married: the DR Division for married/divorcing parents, the Juvenile Division for never-married parents. The court applies the R.C. 3109.04(F) best-interest factors.

How do I file for custody in Lorain County, Ohio?

If you and the other parent were married, custody is decided inside your divorce or dissolution at the Lorain County DR Division, 225 Court Street, Elyria, OH 44035. If you were never married, file a Complaint for Allocation of Parental Rights & Responsibilities in the Juvenile Division at the same address — use the form assistant at lcdrc.ohiolegalhelp.org. A Parenting Proceeding Affidavit and IV-D Application are required, and a Motion for Change of Custody costs $100. Both parents must complete the Separating Parents Seminar before a residential parent is designated.

Custody is the right path if…

  • You need a court order saying who the children live with and how parenting time is divided.
  • You and the other parent can't agree on parenting time, school enrollment, or major decisions.
  • Ohio is the children's home state under the UCCJEA — they've lived in Ohio for the last 6 months.
  • You can complete the Separating Parents Seminar before the final hearing.

Forms & Filing Packets

Custody inside a Lorain divorce/dissolution (married parents) — Included in the $675 divorce-with-children deposit

Custody packet — Juvenile Division (never-married parents)

Filed at the Lorain County Juvenile Division at 225 Court Street. Used when the parents were never married. Paternity must be established before the court can allocate custody.

How to File Custody in Lorain County

  1. Pick the right division — DR or Juvenile. Married/divorcing parents file with the DR case; never-married parents file in the Juvenile Division. Both are at 225 Court Street, Elyria.
  2. Confirm Ohio is the children's home state under the UCCJEA. The children must have lived in Ohio for at least the prior 6 months. The Parenting Proceeding Affidavit (R.C. 3127.23) is how you swear to those facts.
  3. Complete the Separating Parents Seminar. Both parents must finish the free or $25+ seminar. Lorain will not name a residential parent without it.
  4. Assemble the packet and file. DR: Parenting Affidavit + child-support worksheet + IV-D Application with the divorce. Juvenile: Complaint for Allocation of Parental Rights + UCCJEA affidavit + IV-D Application via the Self-Help Center.

Lorain County Practice Notes

  • Combined court, but case type still controls. Lorain's DR and Juvenile divisions share one building and one bench, but married parents file custody with the DR case and never-married parents file in Juvenile. Grandparent/non-parent custody is always Juvenile.
  • Seminar before a residential parent is named. Under DR Local Rule 8 and Juvenile Local Rule 9, the court will not designate a residential parent — or approve shared parenting — until both parents complete the Separating Parents Seminar. Parenting time is held in abeyance until they do.
  • Best-interest standard governs. R.C. 3109.04(F)(1) lists 10+ factors: each parent's wishes, the child's wishes (when of sufficient age), the child's interaction with parents/siblings, adjustment to home/school/community, mental and physical health of all involved, the parent more likely to facilitate court-approved parenting time, child support compliance, criminal history, residence outside Ohio, and any history of abuse.
  • Guardian ad Litem in contested cases. In a contested custody case, the court can appoint a Guardian ad Litem — a court-appointed attorney — to investigate and recommend a parenting plan in the child's best interest. The GAL does not represent the child's wishes; the GAL represents what is best for the child. GAL fees are typically allocated between the parents.

Frequently Asked Questions

Do I file in the Domestic Relations or Juvenile Division in Lorain County?
Lorain County runs a combined Domestic Relations & Juvenile Division at 225 Court Street, but the case type still controls. If you are married to the other parent (or were married when the children were born), custody, parenting time, and support travel with your divorce, dissolution, legal separation, or annulment in the Domestic Relations Division at (440) 329-5277. If you were never married, paternity and custody go to the Juvenile Division at (440) 329-5187. Grandparent / non-parent custody is always Juvenile.
Is the Separating Parents Seminar required in Lorain County?
Yes. Lorain County requires both parents in any case with minor children to complete the Separating Parents Seminar before a final hearing. There are three options: a free in-person session at the Justice Center, a free online Zoom webinar, or the paid online Center for Divorce Education course ($25+) at divorce-education.com/oh/lorain. Complete it within 45 days for a dissolution or 90 days for all other actions. The court will not designate a residential parent or approve shared parenting without compliance, and parenting time is held in abeyance until both parents attend.
When does Lorain County appoint a Guardian ad Litem?
In a contested custody case, the court can appoint a Guardian ad Litem under Sup.R. 48 to investigate and recommend a parenting plan in the child's best interest. A deposit is required before the GAL is appointed — if it is not paid, the underlying motion may be dismissed. GAL fees are taxed against the parties and allocated in the final judgment entry. Lorain also runs Voices for Children at (440) 329-5556, a CASA/GAL program for abused and neglected children.
What does it mean for Ohio to be my child's 'home state' under the UCCJEA?
Under the UCCJEA (R.C. 3127), Ohio is the children's home state when they have lived in Ohio with a parent for at least 6 consecutive months immediately before the filing. If the children recently moved, the prior state may still have jurisdiction. Ohio courts can also decline jurisdiction as an inconvenient forum under R.C. 3127.21 even when home-state requirements are met.
What is a IV-D application and why do I need one?
A IV-D Application opens a child-support case with your county's Child Support Enforcement Agency (CSEA). Once opened, CSEA collects support through automatic wage withholding, distributes it to the receiving parent, and can enforce the order through license suspension, federal tax intercept, credit reporting, and contempt referrals. Filing a IV-D Application is standard whenever a child-support order is issued.
